1. Digital Millennium Copyright Act (DMCA) Compliance

News Speak India respects the intellectual property rights of others. We expect our users and contributors to do the same. To file a notice, you must send a written communication (by email) that includes the items specified below:

1. Identify the Work: specific description of the copyrighted work that you claim has been infringed. If multiple works are covered by a single notification, you may provide a representative list of such works.

2. Identify the Material: A description of where the material that you claim is infringing is located on News Speak India (e.g., the specific URL). This must be reasonably sufficient to permit us to locate the material.

4. Counter-Notice Procedures

If you believe that material you posted on News Speak India was removed or access to it was disabled by mistake or misidentification, you may file a Counter-Notice with us.

Your Counter-Notice must include:

• Identification of Material: Reference the specific URL or content that was removed or disabled.

• Statement of Consent: A statement that you consent to the jurisdiction of the courts in Kolkata, India (or your local jurisdiction if outside India), and that you will accept service of process from the person who provided the original notification.

• Statement of Good Faith: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification.

• Signature: Your physical or electronic signature.

If we receive a valid Counter-Notice, we may restore the removed content in 10-14 business days, unless the original complaining party seeks a court order against us.

5. Repeat Infringer Policy

News Speak India does not tolerate repeated copyright infringement.

• Strike One: We remove the content and issue a warning to the user/author.

• Strike Two: We suspend the user’s ability to post content for 30 days.

• Strike Three: We permanently terminate the user’s account and ban them from the website.

We reserve the right to terminate accounts immediately for severe violations without prior notice.

6. Grievance Redressal Mechanism (For Indian Users)

In accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, we have appointed a Grievance Officer to handle concerns regarding copyright, content violations, or other legal issues.
